What is Cybersquatting?
Cybersquatting is the process of registering a Domain Name consisting of someone else’s Trademark or Service Mark, in bad faith, in an effort to profit from the goodwill of that person’s business. A cybersquatter normally attempts to sell that domain name back to the business owner at a high price or uses the domain name to launch a website that promotes products or services that compete with those offered by the business owner. Cybersquatting issues are often resolved under the Uniform Domain Name Dispute Resolution Policy.
What is the UDRP?
The Uniform Domain Name Dispute Resolution Policy (UDRP), is the legal framework, adopted by the Internet Corporation for Assigned Names and Numbers (ICANN), used to resolve disputes between domain name registrants and a person or entity that wishes to challenge the domain registration as abusive or cybersquatting.
Simply put, it is the set of rules that help determine who should be the rightful owner of a domain name in case a dispute arises.
