Website Privacy Policies

Your business is unique and your Privacy Policy should be too. Simply copying someone else’s Privacy Policy or using a generic one you buy online may cause legal issues for your business.

What is a Website Privacy Policy?

A Website Privacy Policy is a legal document that describes the ways a business gathers, uses, discloses, and manages personal information collected from visitors to its website. Simply put, a Privacy Policy tells visitors of a website what information is collected from them, and how that information is used.

Do I Need A Privacy Policy?

Yes. In some states like California, a Privacy Policy is required. However, even if the state your business is located in does not require a Privacy Policy, it is best practice to have one on your website to give visitors peace of mind by clearly stating your privacy practices.

Your Privacy Policy & California Law

The California Online Privacy Protection Act (CalOPPA) requires all websites that collect “personally identifiable information” from California consumers contain a clearly visible Privacy Policy stating exactly what information is collected from website visitors, and how that information is used.

The Act further requires website owners to comply with their Privacy Policy or be subject to civil litigation under California’s Unfair Competition Law. CalOPPA applies to any person or entity that operates a commercial website or online service that collects and maintains “personally identifiable information” from visitors to the website or online service, who reside in the State of California. Click here to learn more about CalOPPA.
